Materials that are accessible to users in exchange for providing an e-mail address or by purchase (“Gated Content”) are granting you a limited, personal, non-exclusive, non-transferable license to use the Gated Content for your own personal or internal business use. Except as otherwise provided, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, republish, upload, post, transmit, translate, create derivative works of, reverse engineer, alter, enhance, sell, or any way exploit (including digitally via email or other electronic means) any of the Gated Content in any manner. 

You agree that you may only use the Gated Content for your personal or internal business use, provided you keep intact all copyright and other proprietary notices. You agree that you will not sell, redistribute, or create any derivative works based upon the Gated Content and you will not offer any competing products or services based upon any information contained in the Gated Content.

In the event that you sell a similar or competing product or infringe upon our intellectual property rights, we reserve the right to cease your access immediately and permanently.

The Website contains intellectual property owned by us, or any associated resources, including trademarks, copyrights, proprietary information, and other intellectual property. We reserve the right to immediately block your access to the Website and remove you from any service, without refund, if you are caught violating this intellectual property policy.

You are granted a non-exclusive, non-transferable, revocable license to access and use the Website, or any associated resources, and the resources available for download from the Website (the “Content”) strictly in accordance with these Terms of Use.

Our name, logo, slogan, and all related names, logos, product and service names, designs, and slogans are the trademarks of our Company or of our affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners. All content inside the Build Emboldened Hub is protected in this agreement and may be used for individual use, not to be replicated, reproduced, or distributed in any other format, including materials shared by third-party or member companies.

• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity. 

• Interfere with or disrupt any servers or networks used to provide the Website, its features, procedures, policies, or regulations of the networks we use. 

• Gain authorized access to the Website, or any account, computer system, or network connected to the Website by such means as hacking, password mining, or other illicit means. 

• Attempt to or obtain any materials or information through any means not intentionally made available through the Website. 

• Encourage or instigate others to commit illegal activities or cause injury or personal damage to any person or business/organization. 

• Use the Website to post or transmit any unlawful, threatening, abusive, defamatory, obscene, pornographic, or otherwise indecent information of any kind.

• Use the Website to transmit information, software, or other material that violates or infringes upon the rights of others, contains a virus or other harmful component, or exploits any information, software, or material; including materials that is an invasion of privacy or protected by copyright or other proprietary rights without first obtaining written permission from the owner. 

• Solicit anyone to buy or sell products or services, or make donations of any kind, without the express written consent of Company.

To access or use the Website, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms. Children under the age of 18 are prohibited from using the Website or any associated resources.

You may use the Website, for lawful purposes only. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Website and any associated resources. You agree to use the Website, to purchase services or products through the Website, for legitimate, non-commercial purposes only. You shall not post or transmit through the Website, or any associated resources, any material that violates or infringes the rights of others, or that is threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, contains injurious formulas, recipes, or instructions, that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.

By making a Submission to the Website, you represent or warrant that you own or otherwise control all the rights to your Submission described herein including the authority to use and distribute the Submission and that the use or display of the Submission as contemplated in this section will not violate any laws, rules, regulations, or rights of third parties. You agree to hold us harmless from and against all claims, liabilities, and expenses arising out of any potential or actual copyright or trademark misappropriation or infringement claimed against you arising from your Submissions.

You further grant us the right to use your Submission for the purpose of improving our Website, products, or services (and for any other purpose we deem necessary or desirable) without being obliged to pay you any compensation for our use of your Submission. We are under no obligation to post or use any Submission you may provide and may remove any Submission at any time at our sole discretion. If you do send us unsolicited ideas, such ideas will be deemed non-confidential, and we will not be required to provide any acknowledgment of their source.

You may establish a hypertext link to the Website so long as the link does not state or imply any sponsorship of your site by us or the Website. However, you may not, without our prior written consent, frame or inline link any of our Content on the Website or incorporate into another website or service any of our material, content, or intellectual property.

Any testimonials, insights, or earnings projected or shared on documents and/or testimonials are for illustration only. There can be no assurance as to any particular financial outcome based on the use of our website, services, products, or downloadable resources. Your agreement will not hold Company accountable for your earnings, the success or failure of your personal or business decisions, or results of any kind that you may have as a result of information presented to you through the Website. You are solely responsible for your results. 

The testimonials, examples, and photos related to the testimonials used are of actual clients. They are not intended to represent or guarantee that current or future clients will achieve the same or similar results. These are for illustrative purposes only to represent the potential of a potential Client.

If paying by credit or debit card, you grant permission to Company to automatically charge your card as payment for your Product or Service without any additional authorization, for which you will receive an electronic copy. 

In the event that payment is not received by the due date, you will have a three (3) day grace period to make the payment, otherwise, Company reserves the right to cease access immediately and permanently. This does not apply with the Build Emboldened Hub + Network. Service may be terminated immediately upon the first of the month with failed payment. Clients are fully responsible for the full cost of Products and Services. Removal from a Produce or Service does not grant the Client an automatical refund. 

View our Privacy Policy to explore how your information provided as part of a transaction, such as name, address, method of payment, credit card number, and billing information may be collected and used. By completing a transaction, you agree to be financially responsible for all purchases made by the Client or someone acting on your behalf. Transactions allowing access to Products and Services are for legitimate purposes only and not for speculative, false, fraudulent, or illegal purposes.

Company does not tolerate or accept any type of chargeback threat or actual chargeback from your credit card company as agreed upon in the Refund Policy and Terms of Use at the time of purchase. If a chargeback were to occur or a threat made during or post-purchase, Company reserves the right to report the incident to all credit reporting agencies as needed and payment will be required to remove the listing from these respective agencies. 

Unless otherwise provided by law, you acknowledge that Company does not offer refunds for any portion of Client payments for any of our Services, Products, or Coaching, except for where our Conditional Guarantee is expressly written and agreed upon at the initiation of service.

We may at any time amend these Terms, including our Privacy Policy and Disclaimers. The last revision date will be indicated by the “Last updated” date at the top of this page. Any such changes are effective immediately upon notice to you by us posting the new Terms on this Website. We reserve the right to update any portion of our Website, including these Terms, at any time. If you continue to use our Website after we have made revisions, your continued use constitutes consent to the revised Terms, Privacy Policy, and Disclaimers.

While we make every effort to ensure that the content on this Website is free from errors, we do not give any warranty or other assurance as to the accuracy, completeness, timeliness or fitness for any particular purpose of the content and materials on this site beyond reasonable efforts to maintain the site.
